The terms and conditions set out on this page (these “Terms and Conditions”) (together with the Carrier Community Limited Terms and Conditions and the Privacy Policy state the terms and conditions on which you may use the Carrier Community Limited recruitment service (the “Recruitment Service”) and www.carriercommunity.com (the “Website”) in connection with the Recruitment Service, whether you are a guest or a registered user.  Please read this page carefully. If you do not accept the Terms and Conditions stated here, please do not use this Website or Recruitment Service. By using this Website, you are indicating your acceptance to be bound by the terms of these Terms and Conditions and you agree to abide by them.  In the event of any conflict or inconsistency between any provision of the Carrier Community Limited Terms and Conditions and any provision of these Terms and Conditions, the provisions of these Terms and Conditions shall prevail in connection with and/or in respect of your use of the Recruitment Service.

You can browse the Website and respond to recruitment advertisements without being a member of the Website but in order to access certain parts of the Website and to post any recruitment advertisements you must first register with us as a member http://www.carriercommunity.com/forum/profile.php?mode=register. When you register you will be asked to provide Carrier Community Limited with certain information including, without limitation, a valid email address (“Information”). The details provided by you on registration or at any time are important.  You warrant that the Information you provide is true, complete and accurate and you will notify us of any material change to that Information.  If any Information is, or is subsequently shown to be, untrue, inaccurate or incomplete, then Carrier Community Limited reserves the right to refuse or terminate any and all access to, or use of, the Website or Recruitment Service.  Any and all Information provided will be subject to the Carrier Community Limited Privacy Policy.  If you choose, or you are provided with a password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. You shall be responsible for all uses of your membership and registration whether or not authorised by you. You agree to immediately notify Carrier Community Limited of any unauthorised use of your membership or registration or password.  Carrier Community Limited has the right to disable any password, whether chosen by you or allocated by Carrier Community Limited, at any time, if in Carrier Community Limited’s opinion you have failed to comply with any of the provisions of these Terms and Conditions. You are responsible for making all arrangements necessary for you to have access to the Website.

Availability of the Website

Carrier Community Limited aims to have the Website available for you to connect and use 24 hours a day, 7 days a week, however Carrier Community Limited makes no guarantee regarding the availability of the Website.  Carrier Community Limited reserves the right to suspend and withdraw access to some or all of the pages of the Website without notice at any time and accepts no responsibility and excludes any and all liability for these pages not being available. If a fault occurs in the Website, Carrier Community Limited will attempt to correct the fault as soon as it reasonably can. Your access to the Website may be occasionally restricted to allow for repairs or maintenance.  Carrier Community Limited does not warrant: (a) the full functionality of the Website; b) that defects in the Website will be corrected; or (c) that the Website or the server that makes it available are free of viruses or bugs.  

Recruitment Service

You are solely responsible for completing your job posting form and Carrier Community Limited will not be responsible for the content of any posting and expressly excludes its liability for any loss or damage arising from such postings. Prices for posting jobs are set on the Website and you can pay by any credit or debit card stated on the Website. Your credit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be charged for items at this time. No refunds will be made even if Carrier Community Limited removes your posting in accordance with these Terms and Conditions. While Carrier Community Limited tries to ensure that all prices on the Website are accurate, errors may occur. If Carrier Community Limited discovers an error it shall inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel, and you have already paid for posting the job, you will receive a full refund. 

Intellectual Property Rights

Carrier Community Limited owns or is the licensee of all copyright, trade marks and all other intellectual property rights in the Website and the Recruitment Service and all content published on this Website (“Website Content”).  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved. Carrier Community Limited authorises you to view and download a single copy of a page of Website Content or an extract of Website Content solely for your personal, non commercial use.  You must not modify the paper or digital copies of any Website Content you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.  You must retain all copyright, trade mark, service mark and other proprietary notices contained in the original Web Site Content on any copy you make of the Web Site Content. You may not sell or modify the Web Site Content or reproduce, display, publicly perform, distribute or otherwise use the Web Site Content in any way for any public or commercial purpose. By submitting any material, communications or content to the Website, you agree to grant Carrier Community Limited and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, sub-licence, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed for the full term of any rights that may exist in such content.  You warrant that such content does not infringe the copyright, trade mark or any other intellectual property right of any other person. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You also permit any subscriber to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on the Website retains any and all rights that may exist in such content.  

Reliance

Carrier Community Limited does not represent or guarantee the truthfulness, accuracy or reliability of communications or material posted by Carrier Community Limited or users or members and does not endorse any opinions expressed by users or members. You acknowledge that any reliance on material posted by Carrier Community Limited or other users or members will be at your own risk. Carrier Community Limited therefore excludes all liability and responsibility arising from any reliance placed on such materials by any user or member to the Website, or by anyone who may be informed of any of its contents.   

No moderation

Carrier Community Limited acts as a passive conduct for the online distribution and publication of user-submitted material and has no obligation to screen communications or material in advance and is not responsible for screening or monitoring communications or material posted by users or members. Carrier Community Limited will not be responsible as author, editor or publisher of any communications or materials submitted or posted by users or members and Carrier Community Limited expressly excludes its liability for any loss or damage arising from such communications and/or materials by a person in contravention of these Terms and Conditions. Carrier Community Limited is not involved in the actual transaction between employers and candidates. As a result, Carrier Community Limited has no control over the quality, safety or legality of the jobs posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, there are risks including, but not limited to, the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Website.  If requested by you, Carrier Community will use reasonable endeavours to remove any content submitted by you within a reasonable time. If you object to any posting, please contact us at info@carriercommunity.com and if notified by a user of communications or materials which allegedly do not conform to these Terms and Conditions, Carrier Community Limited may investigate the allegation and determine in its sole discretion whether to remove or request the removal of the communication. Carrier Community Limited has no liability or responsibility to users for performance or non-performance of such activities.  Carrier Community Limited reserves the right to expel users, prevent their further access to the Website and remove their communications or materials for breaching the Terms and Conditions.  Carrier Community Limited reserves the right to remove any communications or material submitted or posted without explanation or notice. 

Prohibited Uses

The Website may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. You may not use the Website: 

·          In any way that breaches any applicable local, national or international law or regulation.

·          In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.·          For the purpose of harming or attempting to harm minors in any way.

·          To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

·          To send, knowingly receive, upload, download, use or re-use any material which does not comply with Carrier Community Limited’s submission standards set out below.

hese submission standards apply to all and any material and communications which you submit, post or contribute to the Website and the Recruitment Service.  You must not submit, post or contribute any material or communications that:  

·          In any way that breach any applicable local, national or international law or regulation.

·          Infringes the copyright, trade mark, trade secret or any other intellectual property rights of any other person or violate the privacy, publicity or other personal rights of any other person.

·          Is, or may in our opinion be, defamatory, offensive, vulgar, obscene, harassing, threatening, abusive or hateful, racist, sexist, discriminatory, of a menacing character or cause annoyance, inconvenience, embarrassment or anxiety to any person.

·          Is likely to deceive any person.

·          Is made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

·          Promotes any illegal activity.

·          Is used to impersonate any person, or to misrepresent your identity or affiliation with any person.

·          Gives the impression that they emanate from Carrier Community Limited, if this is not the case.

·          Contains any advertising or promote any services or web links to other sites.

·          Includes any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents.

·          Deletes or revises any material posted by any other person or entity.

 ·          Requires the applicant to any job advertisement to provide information relation to his/her: (a) racial or ethnic origin; (b) political beliefs; (c) philosophical or religious beliefs; (d) membership of a trade union; (e) physical or mental health; (f) sexual life; (g) the commission of criminal offences or proceedings; or (h) age.

·          Contains any hyperlinks, "hidden" keywords or any keywords that are irrelevant to the job advertisement or are otherwise misleading. 

Viruses, hacking and other offences

You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.  By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. Carrier Community Limited will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately. You also agree not to access without authority, interfere with, damage or disrupt: (a) any part of the Website; (b) any equipment or network on which the Website is stored; (c) any software used in the provision of the Website; or (d) any equipment or network or software owned or used by any third party. Carrier Community Limited will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it. 

Exclusions 

The Web Site Content may contain inaccuracies or typographical errors. Carrier Community Limited makes no representations about the accuracy, reliability, completeness or timeliness of the Website or the Website Content. The use of the Website and the Website Site Content is at your own risk.  User authentication on the Internet is difficult and Carrier Community Limited cannot and does not confirm that each user is who they claim to be. Carrier Community Limited does not and cannot be involved in user-to-user dealings or control the behaviour of participants on the Website.  You are solely responsible for authenticating the identity of any user and Carrier Community Limited excludes its liability for any loss and damage arising from any dealings you may have with any other users of the Website.  Carrier Community Limited is not to be considered to be an employer with respect to your use of Website and Carrier Community Limited shall not be responsible for any employment decisions, for whatever reason made by any member posting jobs on the Website.  Carrier Community Limited does not warrant that the Website will operate error-free or that the Website and its server are free of computer viruses or other harmful mechanisms.  

The Website and Website Content are provided on an "as is" basis without any warranties of any kind. All conditions, warranties or other terms that might be implied or incorporated into these Terms and Conditions relating to the Website, Website Content or Recruitment Service whether by statute, common law or otherwise, are excluded to the fullest extent permitted by law.

Liability

The following provisions set out Carrier Community’s entire liability arising out of or in connection with the Website, your use of the Website Content or the Recruitment Service, for breach of contract, negligence and/or any other liability howsoever arising. 

Carrier Community Limited’s liability for death or injury resulting from its own negligence or that of its employees, agents or sub-contractors shall not be limited.

Carrier Community Limited shall not be liable in respect of any: (a) loss of profit, goodwill, business revenue, anticipated savings or contracts; or (b) loss of or corruption to data; or (c) any type of indirect or consequential loss or damage.

Subject to the other provisions of these Terms and Conditions, Carrier Community Limited’s maximum liability will not £100. 

Indemnity

You shall indemnify Carrier Community Limited, its officers, directors, employees and agents from and against any loss, liability, costs, expenses or damage  including, without limitation, reasonable legal and accounting fees, arising out of or in connection with: (a) any material you provide to or post on the Website; (b) any Web Site Content that you use; (c) your breach of any the terms of these Terms and Conditions; or (d) your breach of any law or rights of any party.  

Termination

If Carrier Community Limited considers that a breach of any of these Terms and Conditions has occurred, Carrier Community Limited may at its sole discretion take all or any of the following actions as it deems appropriate: 

·          Immediate, temporary or permanent withdrawal of your right to use the Website and Recruitment Service.

·          Immediate, temporary or permanent removal of any materials or communications already posted on the Website.

·          Issue of a warning to you.

 ·          Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

·          Further legal action against you.

·          Disclosure of such information to law enforcement authorities as it reasonably feels is necessary or as required by law. Carrier Community Limited excludes its liability for all actions it may take in response to breaches of these Terms and Conditions. The actions described above are not limited, and Carrier Community Limited may take any other action it reasonably deems appropriate. 

No Resale or Unauthorised Commercial Use.

You agree not to resell or assign your rights or obligations under these Terms and Conditions. You also agree not to make any unauthorised commercial use of the Website.
